Terms of Service

1. Introduction

These Terms of Service govern your access to and use of CircleDrama, a short-form microdrama entertainment platform made available to eligible users in Kenya.

By accessing or using the Platform, you agree to these Terms. If you do not agree, you must not use the Platform.

In these Terms, "Platform" means the microdrama entertainment service, including any website, mobile page, app, link, player, video content, support channel, feature or related functionality. "We," "us" and "our" refer to the party responsible for operating the Platform. "You" means the person accessing or using the Platform.

2. Eligible user offering

The Platform is made available to eligible users in Kenya as an entertainment platform.

The Platform is separate from any gas supply, LPG delivery, LPG safety, equipment, billing, customer account or other third-party services.

These Terms do not amend or replace any terms that apply to any separate service, account, billing arrangement, safety obligation, equipment or customer relationship you may have with any third party.

For gas supply, LPG safety, billing, delivery, account or emergency matters, you should use the official channels made available by the relevant provider for those purposes.

3. Nature of the Platform

The Platform may be tested, changed, limited, suspended, withdrawn or discontinued at any time.

Access to the Platform does not guarantee that any content, feature or access arrangement will continue in the future.

4. Eligibility

The Platform is intended only for eligible users in Kenya who receive access or are otherwise authorised to use it.

You must not access or use the Platform if:

• you are not eligible;
• you are using another person's access without permission;
• your access has been suspended or withdrawn;
• you are prohibited from using the Platform under applicable law;
• you do not agree to these Terms.

We may verify eligibility using information provided by you, authorised partners or service providers.

5. Account access and security

You are responsible for keeping your device, account and access details secure.

You agree to:

• provide accurate information when required;
• use only your own authorised access;
• keep login or access details confidential;
• not share, sell, transfer or misuse access;
• not allow anyone else to use your access without authorisation;
• notify us if you suspect unauthorised access;
• use the Platform only for lawful and permitted purposes.

We may restrict or suspend access if we believe there is unauthorised use, misuse, fraud, piracy, distribution, technical risk or breach of these Terms.

6. Licence to use the Platform

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable licence to access and stream content through the Platform for personal, non-commercial entertainment purposes only.

This licence does not give you ownership of the Platform, any software, video, episode, storyline, character, image, sound, logo, feature, code, interface or other content.

All rights not expressly granted to you are reserved.

7. Content and intellectual property

If you believe content available through the Platform infringes your intellectual property rights, you may contact us with sufficient details so we may review the matter and take appropriate action where required.

The Platform and its content are protected by copyright, trademark and other intellectual property laws.

All rights in the Platform and its content belong to us, our licensors or the relevant rights holders.

You must not:

• copy, record, download, rip, capture, reproduce or redistribute content;
• screenshot, screen-record or otherwise capture content except where expressly allowed by us in writing;
• sell, rent, sublicense, broadcast, transmit or publicly display content;
• upload, post, share, forward or make Platform content available on any other platform, website, app, social media channel, messaging service or file-sharing service;
• distribute links, access credentials, files or copies that enable unauthorised access to Platform content;
• remove, obscure or alter copyright, trademark, watermark, digital rights management or ownership notices;
• bypass, disable, interfere with or circumvent access controls, technical protection measures, geo-restrictions, watermarking, monitoring tools or digital rights management;
• create derivative works from the Platform or its content;
• use the Platform or content for commercial purposes without permission.

Any unauthorised copying, recording, distribution, sharing, uploading, broadcasting or public display of Platform content is strictly prohibited and may result in suspension or termination of access and further action where permitted by law.

8. Acceptable use

You agree not to:

• use the Platform for unlawful, harmful, fraudulent or abusive purposes;
• use false information to obtain access;
• create or maintain unauthorised multiple accounts or access routes;
• impersonate another person;
• share, sell, transfer, rent or resell your access;
• interfere with the operation, monitoring or security of the Platform;
• bypass, disable or circumvent access controls, security features, technical restrictions, digital rights management, watermarking or anti-piracy controls;
• hack, attempt to hack, probe, scan, test the vulnerability of or gain unauthorised access to the Platform, systems, accounts, networks or data;
• scrape, crawl, index, extract, harvest or copy data or content;
• use bots, scripts, automation tools, emulators, unauthorised plug-ins or unauthorised software;
• reverse engineer, decompile, disassemble, modify, tamper with or create a competing version of the Platform;
• introduce viruses, malware, harmful code or disruptive commands;
• use the Platform in a way that infringes intellectual property, privacy or other rights;
• harass, threaten, abuse or harm others through the Platform.

9. Monitoring and enforcement

We may monitor access to and use of the Platform to operate the Platform, secure the Platform, detect misuse, prevent fraud, protect intellectual property and enforce these Terms.

Monitoring may include review of usage patterns, device signals, IP addresses, access logs, security events, unusual viewing activity, account-sharing indicators, suspected recording, suspected downloading, suspected scraping and suspected unauthorised distribution.

We may investigate suspected breaches and may restrict, suspend or terminate access where we reasonably believe that the Platform, content, users, rights holders or systems are at risk.

10. Feedback and communications

If you send us feedback, suggestions, comments or ideas about the Platform, you allow us to use them to improve, operate or promote the Platform without compensation to you, unless applicable law requires otherwise.

You must not submit anything that is unlawful, infringing, confidential, harmful, misleading or abusive.

11. Service availability

We aim to provide a reliable Platform, but we do not guarantee that the Platform will always be available, uninterrupted, error-free or compatible with every device, browser, network or operating system.

The Platform may be unavailable because of maintenance, technical issues, connectivity problems, security events, content changes, legal requirements or operational reasons.

12. Content availability and changes

The videos, episodes, series, categories and features available through the Platform may change from time to time.

We may add, remove, restrict, update or replace content or features at any time.

We do not guarantee that any particular video, episode, series, category or feature will remain available.

13. Access to the Platform

Access to the Platform is made available only as described in the invitation, access message or instructions provided to eligible users.

These Terms do not grant any right to ongoing access, and access may be changed, limited, suspended or withdrawn in accordance with these Terms.

14. Privacy

Our Privacy Policy explains how personal data is collected, used, shared, stored, monitored and protected in connection with the Platform.

By using the Platform, you acknowledge that personal data will be handled as described in the Privacy Policy.

15. Third-party services

The Platform may depend on third-party services, such as hosting, video delivery, analytics, authentication, customer support, device platforms or connectivity providers.

We are not responsible for third-party services, websites, platforms, networks or devices that we do not control.

Your use of third-party services may be subject to separate terms and privacy notices.

16. Suspension or termination

We may suspend, restrict or terminate your access to the Platform if:

• you breach these Terms;
• we cannot verify your eligibility;
• your access appears unauthorised, fraudulent, shared, resold or misused;
• you copy, record, download, upload, distribute or attempt to distribute Platform content;
• you attempt to hack, bypass, disable, tamper with or interfere with the Platform or its protection measures;
• your use creates legal, technical, security, intellectual property or operational risk;
• we are required to do so by law;
• the Platform is changed, withdrawn or discontinued.

You may stop using the Platform at any time.

Upon suspension or termination, your right to access and use the Platform ends immediately.

17. Entertainment-only service

The Platform is provided for entertainment purposes only.

The Platform does not provide gas supply, LPG delivery, LPG safety guidance, emergency services, billing support, financial services or account management for any third-party service.

For gas-related or other third-party service matters, you should use the official channels of the relevant provider.

18. Disclaimers

To the maximum extent permitted by applicable law, the Platform is provided on an "as is" and "as available" basis.

We do not guarantee that:

• the Platform will always be available;
• the Platform will be uninterrupted or error-free;
• all content will remain available;
• the Platform will meet your expectations;
• the Platform will be compatible with every device, browser, operating system or network;
• defects or errors will always be corrected.

Nothing in these Terms excludes or limits rights that cannot be excluded or limited under applicable law.

19. Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential or punitive losses arising from or related to the Platform.

This may include loss of access, loss of data, device issues, service interruptions, content unavailability, unauthorised access caused by your failure to protect your device or access details, or circumstances outside our reasonable control.

Nothing in these Terms limits liability that cannot be limited under applicable law.

20. Indemnity

To the extent permitted by applicable law, you agree to be responsible for losses, claims, damages, liabilities and expenses arising from:

• your breach of these Terms;
• your misuse of the Platform;
• your unlawful conduct;
• your unauthorised copying, recording, uploading, sharing or distribution of content;
• your attempt to hack, bypass, disable, tamper with or interfere with the Platform;
• your infringement of another person's rights;
• unauthorised use caused by your failure to protect access details.

21. Changes to these Terms

We may update these Terms from time to time.

If we make material changes, we will take reasonable steps to notify users, such as by posting the updated Terms through the Platform or another appropriate channel.

Your continued use of the Platform after the updated Terms become effective means you accept the updated Terms.

22. Governing law

These Terms are governed by the laws of Kenya, except where mandatory law provides otherwise.

Any dispute arising from or relating to the Platform will be handled in accordance with applicable Kenyan law.
